These terms set out the general basis on which I provide marketing services to clients. They are intended to keep expectations clear and help ensure that projects run smoothly for both sides.
These terms apply to all services provided by Tim Bateup Marketing unless otherwise agreed in writing.
By instructing or commissioning work, the client confirms that they have read and accepted these terms.
Where services are agreed by email or written proposal, those communications together with these terms form the basis of the agreement between the parties.
Information provided on this website is offered for general guidance and does not constitute professional advice.
1. Services
Tim Bateup Marketing provides marketing strategy, website reviews, content development, and related advisory services for owner-operated service businesses.
Services may include, but are not limited to:
- marketing strategy and positioning advice
- website review and improvement recommendations
- written website content
- marketing messaging and copywriting
- blog articles and knowledge resources
- general marketing consultation
The precise scope of work for each engagement will normally be agreed in advance by email or written proposal.
Unless explicitly agreed, services relate to strategic advice and content creation, not the implementation of technical website changes, advertising campaigns, or other operational marketing activities.
Services are provided with reasonable care and professional diligence.
2. Client responsibilities
The client is responsible for:
- providing accurate information about their business, services and claims
- reviewing all content provided before publication
- ensuring that any published content complies with applicable laws, regulations, and industry standards.
While reasonable care is taken in preparing marketing content, the client remains responsible for confirming the factual accuracy and legal suitability of all published material.
3. Client-supplied information and materials
The client warrants that any materials they supply for use in marketing work — including text, images, claims, data, or branding:
- are accurate and lawful
- do not infringe the intellectual property rights of third parties.
Tim Bateup Marketing accepts no responsibility for inaccuracies or legal issues arising from information supplied by the client.
4. Intellectual property
Unless otherwise agreed in writing:
Copyright in written content created as part of the services transfers to the client once payment has been made in full.
After payment, the client is free to use, modify, publish, or distribute the content as they see fit.
Tim Bateup Marketing reserves the right to:
- reference the work in portfolio materials
- describe the project in general terms for professional purposes.
5. Approval of content before publication
The client is responsible for reviewing and approving all content before it is published or distributed.
Publication of the material by the client constitutes acceptance of the content in its final form.
6. Client cooperation and delays
Marketing projects often depend on timely feedback, information, and approvals from the client.
Where delays occur because required materials, feedback, or decisions are not provided within a reasonable timeframe, project timelines may need to be adjusted accordingly.
Tim Bateup Marketing cannot be held responsible for delays caused by a lack of client input or approval.
7. Third-party services and platforms
Some marketing recommendations may involve the use of third-party services or platforms such as website hosting providers, analytics tools, social media platforms, or advertising networks.
Tim Bateup Marketing does not control these services and cannot guarantee their availability, policies, or future performance.
The client remains responsible for their own accounts and agreements with any third-party providers.
8. Payment
A deposit of 50% is payable at the time of booking the work. The remaining 50% is payable within 14 days of the work being completed.
Work may be paused or withheld if invoices remain unpaid beyond the agreed payment period.
9. Revisions and scope of work
Where written content is provided, reasonable revisions are included to ensure the material accurately reflects the client’s business and tone.
Revisions are intended to refine and clarify agreed material. Requests that substantially change the scope of the original work — including significant rewrites, new sections, or additional content — may be treated as additional work and quoted separately.
10. Limitation of liability
Tim Bateup Marketing provides professional marketing advice and content services. However:
- marketing outcomes cannot be guaranteed
- search engine rankings, traffic levels, and commercial results depend on many factors beyond the control of the service provider.
To the fullest extent permitted by law, Tim Bateup Marketing shall not be liable for:
- business losses
- lost profits
- indirect or consequential losses
- claims arising from the client’s use of published content.
11. Professional judgement
All advice and recommendations are provided based on professional judgement and experience working with businesses.
The client remains responsible for deciding whether and how to implement any recommendations.
12. Right to refuse work
Tim Bateup Marketing reserves the right to decline or discontinue work where a project:
- falls outside the scope of services offered
- involves misleading, unethical, or unlawful marketing practices
- creates a conflict of interest.
13. Termination
Either party may terminate an engagement at any time by written notice.
Where work has already been completed, payment remains due for services delivered up to the point of termination.
14. Governing law
These terms are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales.
